1. How do I get started?
Sign up a free account by filling out the application form. After a review process by our affiliate manager, we’ll send you an email with your password and other information. As our affiliate, you will have your own control panel where you can see detailed statistics of the traffic and sales you referred, and choice of promotional tools.
2. How do I promote Diamond Bakery's products?
You can promote our products via search engines, posting links on your Facebook wall, sending out Tweets, displaying Diamond Bakery banner ads on your website or blog, email marketing, or by simply emailing friends and people you know with your affiliate link to our products.
TERMS & CONDITIONS
ACCEPTANCE OF TERMS
Your access to and use of Diamond Bakery's Tell-A-Friend Program is subject to these Terms and Conditions. You shall not use the Website and/or the Program for any purpose that is unlawful or prohibited by these Terms and Conditions and legal requirements. By registering for and using the website or the program you are fully accepting the terms, conditions and disclaimers contained in this document and all policies and guidelines that are incorporated by reference. If you do not accept these terms and conditions you must immediately stop using the Website and/or the Program.
USE OF YOUR ACCOUNT
You must be 18 years old or older and lawfully can enter into and form contracts under applicable law. You must provide accurate contact information required in the registration form. You authorize Diamond Bakery to verify the accuracy of your information and to perform credit or background checks, as it desires. Diamond Bakery may deny or terminate any Account to any person for any reason. You are solely responsible for maintaining the confidentiality of your unique logon ID and password, and for their use.
PROMOTION RULES
1. You shall not misrepresent Diamond Bakery, its Website, Products and/or Programs. You shall not use Diamond Bakery's logo or any image and text links in any way that could dilute Diamond Bakery's identity and cause confusion to the public. You shall also not to promote Diamond Bakery Products on web sites that make available or promote sexually explicit material, violence, illegal software or pirated materials, or sites that promote discrimination based on race, sex, religion, national origin, or physical disability or sites that promote illegal activities.
2. You shall not promote Diamond Bakery's Website and Products by use of "spamming" unsolicited commercial email, postings to forums, message boards, non-commercial newsgroups and cross-posting to multiple newsgroups at once or advertise in any way that effectively conceals or misrepresents your identity, your domain name or your return email address or in any other way that is likely to tarnish or damage Diamond Bakery's reputation. In addition, you (a) shall not use the Website address or any combination of Diamond Bakery name in the meta tags keywords or description of any web page, (b) submit the Website address or any confusingly similar web site address to any search engine or directory, or (c) register any domain name confusingly similarly (or deliberately misspelled) to that of the Website address.
3. You must not directly or indirectly offer any person any consideration or incentive, including, without limitation, payment of money or awarding of any benefits, for using the Links on your Website to access our Website. In addition to any other rights we may have, such actions may result, at our sole discretion, in the withholding of commission fees and/or the termination of this Agreement.
4. You can only promote Diamond Bakery's products using approved promotional content such as banner ad graphics, HTML text ads, text links, and HTML email content that can be found and downloaded under your affiliate account.
PAYMENTS TO YOU
For a sale to generate a referral commission, the referrer must follow your affiliate link to Diamond Bakery's website and purchase the products from Diamond Bakery. Your commission rate is 5% of the net total of each purchase made by your referrers. If your balance meets the minimum of $20 or more at the time of payment processing, you will receive a reward payment once a month to your PayPal account. You are required to have a PayPal account (in order to receive payouts) and solely responsible for opening and maintaining your PayPal account and providing Diamond Bakery with the correct information sufficient to make settlements. You may not receive credit for referring yourself.
TAXES
You agree that you are solely responsible for determining the amount of any taxes that you may owe as a result of the commission income, and are solely responsible to collect, report and remit any such taxes required under law applicable to you. You acknowledge and agree that Diamond Bakery has no responsibility to collect, report or remit any applicable taxes in connection with the commission income. You hereby agree to fully indemnify, defend and hold Diamond Bakery harmless from any and all claims, demands, damages, awards, fines, costs, expenses and liability in any way associated with the foregoing obligations or otherwise with respect to any claim, demand or allegation of any tax in any way associated with the commission income.
COPYRIGHT
All copyright, trademarks and all other intellectual property rights in Diamond Bakery's and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Diamond Bakery or otherwise used by Diamond Bakery as permitted by law.
None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder.
TERMINATION
At anytime and for any reason using its sole discretion, Diamond Bakery may terminate this agreement, your access to the Website and/or the Program, your Account at any time without notice to you. Diamond Bakery shall have no liability or obligation for the termination of this agreement.
